REPORT AND RECOMMENDATION that Defendants' MOTION for Summary Judgment 26 be granted in part and denied in part. Specifically, Defendants' Motion should be granted with the exception of Plaintiffs First Amendment retaliation claim that Defendant Orpen conducted a retaliatory cell search on June 3, 2002, and Plaintiffs Eighth Amendment claim of excessive force by Defendant Orpen on June 4, 2002. Defendants did not move for dismissal of Plaintiffs state law claims and, therefore, they remain pending in this action.
