MEMORANDUM and ORDER granting 24 Motion for Final Approval of the Class Action Settlement and granting 26 Motion for Award of Attorneys Fees, Reimbursement of Expenses and Payment of Plaintiff Incentive Award; Court, for the purposes of this Judgement and Order of Dismissal, adopts all defined terms as set forth in the Class Action Settlement Agreement; Court has subject matter jurisdiction pursuant to 28 U.S.C. ยง 1331 and has personal jurisdiction over the class representative, the members of the settlement class and defendant Kings Family Restaurants; Court finds that the Notice to Class members constituted the best notice practicable and distribution of the notice was adequate; Court approves the settlement of this case, as set forth in the Settlement Agreement, and finds that each of the releases and other terms are fair, reasonable and adequate as to the Settling Parties; Settling Parties are directed to perform in accordance with the terms set forth in the Settlement Agreement; All of the released claims are dismissed with prejudice, and the Settling Parties are to bear their own attorneys fees and costs, except as otherwise provided in the Settlement Agreement; Court has conditionally certified a class of all Members of the Settlement Class as that term is defined in the Stipulation; Court finds that the settlement is fair, reasonable and adequate and satisfies the requirements of Fed.R.Civ.P. 23; Class representative shall release each claim of the settlement class members as stated more fully in order; Only settlement class members entitled to relief pursuant to this judgment are participating claimants; Defendant has agreed to pay Class Counsel their reasonable attorneys fees as well as certain allowable costs in this matter; Court reserves exclusive and continuing jurisdiction over this matter and the parties; This document is a judgment for purposes of Fed.R.Civ.P. 58; This matter is hereby DISMISSED, with PREJUDICE, and Clerk is directed to mark this case CLOSED.
