MEMORANDUM AND OPINION granting plaintiffs ERBE's 14 motion for summary judgment. Plaintiffs correctly assert that Canady's counterclaim against ERBE is no more than a restatement of Canady's affirmative defense to ERBE's complaint. Under these circumstances and because this court concluded that ERBE's motion for summary judgment should be granted, ERBE's motion to dismiss Canady's 15 counterclaim must also be GRANTED. Pursuant to the Recognition Act, 42 P.S. ยงยง 22001 et seq., this court recognizes the judgments of the United Kingdom High Court of Justice, Chancery Division awarding attorneys' fees to plaintiffs, as well as the orders of the United Kingdom Supreme Court Costs Office setting those attorneys' fees at $525,209.70. Signed by Judge Joy Flowers Conti on 2/19/08. (cal )
