MEMORANDUM OPINION AND ORDER that insofar as 5 Defendant's Motion seeks to dismiss this matter for lack of personal jurisdiction pursuant to Fed.R.Civ.P. 12(b)(2), or for Improper Venue pursuant to Fed.R. 12(b)(3), it is DENIED. Insofar as the Defendant's Motion requests that this matter be transferred to the United States District Court for the Southern District of New York pursuant to 28 U.S.C. Section 1406(a), it is GRANTED. The court does not reach that portion of the Defendant's Motion requesting, pursuant to Fed.R.Civ.P. 12(b)(6), that this matter be dismissed for failure to state a cause of action. The Court instructs the Clerk of this Court to transfer this case FORTHWITH to the United States District Court for the Southern District of New York.
