ORDER granting in part and denying in part 32 Motion to Dismiss; granting in part and denying in part 36 Motion to Dismiss. Plaintiff's claims against the individual police officers and chief in their official capacity are dismissed, along with all substantive and procedural due process and Ninth Amendment claims. Baden Police Department is dismissed from this case as plaintiff's Second Amended Complaint abandons any claims against that sub-unit of Baden Borough.
