MEMORANDUM OPINION & ORDER - IT IS ORDERED THAT: 1. Third-Party Defendant New York City Transit Authority's motion 61 to dismiss the Third-Party Complaint, is GRANTED; 2. Third-Party Defendant Kawasaki Rail Cars, Inc.s motion 58 to dismiss the Third-Party Complaint, is GRANTED; 3. United Chemi-Con, Inc.s Third-Party Complaint is DISMISSED with prejudice; 4. The Clerk of Court is directed to TERMINATE New York City Transit Authority and Kawasaki Rail Cars, Inc. as Third-Party Defendants in this matter; 5. The parties Joint Motion 78 for Status Conference, is GRANTED; and 6. A telephone status conference will be held on April 6, 2018 at 10:00 a.m. Plaintiffs counsel shall initiate the call.
