MEMORANDUM OPINION AND ORDER granting 32 Motion to Dismiss Amended Complaint in Part. It is hereby Ordered as follows: 1. Plaintiff's Title VII claim (Count 1) against Defendant Specialty Hospital Johnstown, Inc. is DISMISSED only to the extent it asserts a constructive discharge claim. 2. Plaintiff's battery claim (Count 3) is DISMISSED only to the extent it asserts a constructive discharge claim. 3.
