MEMORANDUM OPINION AND ORDER denying as moot 9 Motion to Dismiss; granting 21 Motion to Amend/Correct. Plaintiff has already filed a First Amended Complaint (ECF No. 20). The First Amended Complaint is the operative complaint going forward. Frontier shall have 21 days (until January 25, 2018) to respond to Plaintiff's First Amended Complaint. The parties shall have 21 days (until January 25, 2018) to file an Amended Proposed Initial Scheduling Order. The parties must indicate in the Order that they agree to all the dates contained therein. Additionally, the parties must state in the Order whether they wish to hold the Post-Discovery Status Conference scheduled for February 7, 2018, or whether they wish to reschedule the conferdified on 1/5/2018. MEMORANDUM OPINION AND ORDER granting 37 Errata re 35 Motion to Compel Production of Documents and for Sanctions. Accordingly, the Court ORDERS Plaintiff to: (1) Produce the e-mails referenced in "Addendum A" in native format or another format agreed to by Defendant; (2) Produce any relevant text messages in native format or in another format agreed to by Defendant or state that these messages to do not exist; and (3) Pay Defendant's reasonable attorney's fees and costs incurred in filing the instant Motion to Compel. The Court further Orders Defendant to file via CM/ECF a document setting forth its itemized attorney's fees and costs, if any, related to the instant Motion to Compel on or before April 4, 2018.
