OPINION AND ORDER granting 132 motion for summary judgment and denying 140 motion to dismiss. The Court determines--after weighing all of the pertinent factors--that the interests of justice counsel against allowing Plaintiffs to dismiss their claims without prejudice and potentially bifurcate this case. Thereafter, because of the lack of evidence and several procedural faults, the Court found that Plaintiffs are unable to knock Defendants off Mt. Healthy. Finally, after considering its underlying policies, the Court declines to exercise supplemental jurisdiction over all remaining state law claims. Thus, Plaintiffs' First Amendment political discrimination claims are DISMISSED WITH PREJUDICE and all other state law claims are DISMISSED WITHOUT PREJUDICE. Signed by Judge Daniel R.
