OPINION AND ORDER granting 418 Motion for Reconsideration as to Lemuel Velilla-Reyes (1). The Court holds as a matter of law that no reasonable juror could have found beyond a reasonable doubt that these mailings were in furtherance of Defendant Lemuel Velilla-Reyes' scheme. The Court GRANTS Defendant's motion (Docket No. 418), RECONSIDERS its prior ruling denying Defendant's motion, and ORDERS the entry of judgment of acquittal on Counts One and Two of 15-cr-410 (DRD) pursuant to Rule 29. See Fed. R. Civ. P. 29(c)(2)("If the jury has returned a guilty verdict, the court may set aside the verdict and enter an acquittal.").Sentencing will proceed as scheduled.
