MEMORANDUM AND ORDER re 40 Report and Recommendation; re 14 Motion to Dismiss for Failure to State a Claim and Motion to Dismiss for Lack of Jurisdiction; and re 27 Motion to Dismiss. The Court ADOPTS IN PART and REJECTS IN PART the magistrate judge's R & R. The Court GRANTS IN PART and DENIES IN PART defendant's motion to dismiss the amended complaint. Defendants' motion to dismiss the declaratory judgment claim is GRANTED, and plaintiff's declaratory judgment claim is DISMISSED WITH PREJUDICE. Defendants' motion to dismiss the remaining claims is DENIED. Defendants' motion to dismiss the original complaint is MOOT. The Court ORDERS plaintiff Marietti to show cause, no later than July 27, 2015, whether the Court has jurisdiction over her claim brought pursuant to Rule 69. Signed by Judge Francisco A.
