OPINION AND ORDER: Before this court is the remaining claim of inequitable conduct as well as numerous post trial motions. The evidence is insufficient to establish that any statement made to the PTO by Bowling was either a misrepresentation or intended to deceive, in thus Hasbro's claim of inequitable conduct fails. Court makes the following rulings on the parties' post trial motions: granting 211 Motion to Alter Judgment; granting 212 Motion for Bill of Costs; denying 213 Motion ; denying 214 Motion for Attorney Fees; denying 215 Motion ; denying 216 Motion for Judgment as a Matter of Law. So Ordered by Judge William E Smith on 8/23/2008. (Geile, Wendy)
