REPORT AND RECOMMENDATIONS re 35 MOTION to Dismiss as to Defendants Conrad Mir and Carl O'Connell filed by Timothy Conley, 36 MOTION to Vacate Default and Default Judgment as Against Defendant Competitive Technologies, Inc. filed by Conrad Mir, Carl O'Connell, Competitive Technologies, Inc. Recommending that the motion to vacate 36 be granted in part and denied in part. Specifically, recommending that the Court leave the default judgment as to liability in place, but vacate the default as to the amount of damages. Because I am not recommending that the final judgment of default against CTI be left in place, I also recommend that Plaintiffs contingent motion to voluntarily dismiss the individual Defendants 35 be denied without prejudice. Defendant Competitive Technologies, Inc.'s 36 Motion to Vacate is DENIED with respect to liability and GRANTED with respect to a determination of damages.
