REPORT AND RECOMMENDATIONS re 14 MOTION for Judgment on the Pleadings filed by Wells Fargo Bank N.A., Harmon Law Offices, PC, 13 MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM filed by Wells Fargo Bank N.A. Based on Plaintiff Brenda Pimentals request, I recommend that Count 3 of the complaint be voluntarily dismissed with all parties to bear her or its own fees and costs pursuant to Fed. R. Civ. P. 41(a)(2). Further recommending that Defendant Wells Fargo Bank, N.A.s Motion to Dismiss 13 Counts 1 and 2 of the complaint be DENIED and that Defendant Harmon Law Officers, P.C.s Motion for Judgment on the Pleadings 14 as to Counts 1 and 2 be GRANTED.
