MEMORANDUM OPINION: For the reasons stated herein, the Court finds that Petitioner is not entitled to relief under 28 U.S.C. ยง 2254 and her motion for partial summary judgment (Doc. 45) will be DENIED. Respondent's motion for summary judgment (Doc. 42) will be GRANTED, and the petition for a writ of habeas corpus (Doc. 19) will be DENIED. After reviewing each of Petitioner's claims, the Court finds that reasonable jurists could not conclude that Petitioner's claims are adequate to deserve further review, nor would reasonable jurists debate the correctness of the Courts procedural ruling. As such, because Petitioner has failed to make a substantial showing of the denial of a constitutional right, a COA will not issue.
