MEMORANDUM OPINION: For the reasons in this memorandum opinion, petitioners appeal of the Magistrate Judges order will be DENIED, and that order will be AFFIRMED; petitioners motion for a determination of the status of this case will be GRANTED; his motion for a hearing will be DENIED; respondents motions to dismiss and for judgment as a matter of law will be GRANTED, and this petition and amended petition will be DISMISSED.
