MEMORANDUM AND OPINION. For reasons stated in this document the Respondent's motion to dismiss Doc.10 will be GRANTED as to all claims. Petitioner is not entitled to an evidentiary hearing, and his 2255 petition Doc. 2 will be DISMISSED. Finally, the Court must decide whether to issue a certificate of appealability. The Court now finds that reasonable jurists could not disagree with the resolution of these claims and could not conclude that they "are adequate to deserve encouragement to proceed further," and will DENY issuance of a COA as to all claims.
