MEMORANDUM OPINION AND ORDER as to Steven Thomas Kotsonis. After careful review of the entire record, including the Magistrate Judge's thorough R&R, the R&R will be AFFIRMED and ADOPTED as the order of the Court. For the reasons stated by the Magistrate Judge, this claim lacks merit.For the reasons set forth above, the Court holds that neither petitioner's prosecution in this court nor his sentencing was in violation of the constitution or laws of the United States and he is not entitled to an evidentiary hearing. His motion to vacate, set aside or correct his sentence pursuant to 28 U.S.C. § 2255, [Docs. 58, 59], are DENIED. Because petitioner has failed to make a substantial showing of the denial of a constitutional right, a certificate of appealability will not issue. For the reasons set forth in the accompanying Memorandum and Order, the Court finds that petitioner Steven Thomas Kotsonis's conviction and sentencing were not in violation of the Constitution or laws of the United States and, therefore, DENIES petitioner's motion to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255, [Docs. 58,59]. Further, the Court finds that petitioner has failed to make a "substantial showing of a denial of a constitutional right" and a certificate of appealability will be denied as to the issues raised by petitioner.
