MEMORANDUM OPINION re Motion to Vacate Doc. 53 as to Rickie Lee Hoyle, Jr. Because the claim raised in this ยง 2255 motion has been procedural defaulted and, alternatively, is meritless, the Court will DENY the motion. The Court must now consider whether to issue a certificate of appealability (COA) should Petitioner file a notice of appeal. Because Petitioner has failed to make a substantial showing of the denial of a constitutional right, a COA will not issue. AN APPROPRIATE ORDER WILL FOLLOW.
