MEMORANDUM OPINION AND ORDER: The named, individual capacity defendants move for summary judgment, Doc. 31, based upon qualified immunity. Because there are no genuine issues of material fact as to whether a constitutional violation occurred and because there are no issues of fact that the defendants violated a clearly established right, the defendants motion is GRANTED. Based on the current record, there is no genuine issue of material fact that Sheriff Hensley possessed information revealing a strong likelihood of unconstitutional conduct by his subordinates and did nothing to prevent the conduct. As such, the section 1983 claim against him in his individual capacity is DISMISSED. A Scheduling Order will enter shortly with regard to the remaining claims.
