JUDGMENT as to Anthony Douglas Williams (1): Counts 1,4 of the Indictment- A total term of 286 months. 226 months as to Count One and 60 months as to Count Four, with terms to run consecutively for a net sentence of 286 months. The sentence shall run concurrently to any sentence imposed in Kingsport General Sessions Court Docket Number K00324000, K00324001 and Washington County Criminal Court Docket Number 39545. The sentence shall run consecutively to any sentence imposed in Washington County Criminal Court Docket Numbers 39547 and 39549; a total term of three (3) years on Count One and three (3) years on Count Four, with terms to run concurrently for a net term of three (3) years supervised release and a special assessment of $200; All remaining counts as to this defendant in this case are dismissed on the motion of the United States. ORDER as to Anthony Douglas Williams re 40 MOTION to Vacate under 28 U.S.C. 2255 On March 6, 2016, the Supreme Court held that the United States Sentencing Guidelines are not amendable to vagueness challenges. Beckles v. United States, No. 15-8544, 2017 WL 855781, at *7 (U.S. March 6, 2017). Because the Johnson decision does not undermine sentences based on Guideline enhancements, the Court believes summary denial of the above petitions with prejudice might be appropriate. To the extent that the parties disagree, the Court affords the following notice: the parties should file any motion that they want the Court to consider in conjunction with, or prior to, ruling on these petitions on or before April 1, 2017.
