REPORT AND RECOMMENDATION as to Latari Monique Jackson re 119 MOTION to Vacate under 28 U.S.C. 2255 , 100 MOTION to Vacate under 28 U.S.C. 2255. Based upon all of the testimony and the totality of the circumstances, the Court finds that Jackson did not specifically request her trial counsel to file an appeal. The Court further finds that under these circumstances, trial counsel had no further duty to consult with Jackson after sentencing about filing an appeal. Finally, even if trial counsel should have consulted with herafter sentencing, Jackson has not identified any prejudice from his failure to do so.
