MEMORANDUM AND ORDER: Plaintiff's motion for leave to proceed in forma pauperis [Doc. 1] is GRANTED. However, no process shall issue and this action will be DISMISSED for failure to state a claim upon which relief may be granted. As such, Plaintiff's motion to appoint counsel [Doc. 3] will be DENIED as moot. Because Plaintiff is an inmate in the Larimer County Jail, he is herewith ASSESSED the civil filing fee of $350.00. The Clerk is DIRECTED to send a copy of this Memorandum and Order to the Sheriff of Larimer County, Colorado. The Clerk is further DIRECTED to forward a copy of this Memorandum and Order to the Court's financial deputy. Further, the Court CERTIFIES that any appeal from this order would not be taken in good faith and the Court will therefore DENY Plaintiff leave to appeal in forma pauperis.
