ORDER finding that plaintiff has not shown that Thomas Ebeling possesses unique personal knowledge relevant to the instant litigation. Plaintiff shall be precluded from deposing Ebeling. However, plaintiff shall be allowed to take Ebeling's deposition upon written questions pursuant to Rule 31 FRCvP. If, after further discovery, there is some indication that Ebeling possesses unique personal knowledge relevant to this case, then plaintiff may renew his request to depose Ebeling at that time. ORDER regarding discovery items. The Court SUSTAINS the defendant's Objection to Plaintiff's First Request for Production of Documents Request 4(f). The Defendant's Objection to Request 7 is SUSTAINED in part and OVERRULED in part. The Defendant shall produce the requested information relating to individuals whose progress through the training program was under the supervision of the plaintiff's Regional Director, Jeff Griffin. Defendant's Objections to Request 8 are SUSTAINED. The Court finds that Request 15 is essentially a duplicate of Request 4(f) and SUSTAINS defendant's objection to Request 15 for the same reasons discussed above with respect to Request 4(f).
