MEMORANDUM OPINION as to David W Sharp. Petitioners motion to amend his § 2255 motion Doc. 76, and his Motion for Permission to Take Discovery Doc. 77 will be DENIED. In addition, Petitioners 28 U.S.C. § 2255 motion Doc. 70 will be DENIED and DISMISSED WITH PREJUDICE. The Court will CERTIFY that any appeal from this action would not be taken in good faith and would be totally frivolous. Therefore, this Court will DENY Petitioner leave to proceed in forma pauperis on appeal. See Fed. R. App. P. 24. Petitioner has failed to make a substantial showing of the denial of a constitutional right, therefore, a certificate of appealability SHALL NOT ISSUE. 28 U.S.C. § 2253; Fed. R. App. P. 22(b).
