MEMORANDUM AND ORDER e as to Ricky Williams Cline (1). This case is before the Court on Defendant Cline's Motion for Production of Specific Brady Discovery 52, filed on August 31, 2016. The Government has provided the requested TWRA manual, and the parties have stipulated that it is against ATF policy to lose a witness statement. Accordingly, the Defendant no longer requires a court order to obtain the requested information, and his Motion for Production of Specific Brady Discovery 52 is DENIED as moot. MEMORANDUM OPINION AND ORDER re the Report and Recommendation of Magistrate Judge C. Clifford Shirley, Jr., entered on December 14, 2016 Doc. 67 as to Ricky Williams Cline (1). For the reasons discussed herein, and upon careful and de novo review of the record and the law, the Court hereby OVERRULES the defendants objection to the R&R Doc. 68 and SUSTAINS the governments objection Doc. 70. The Court REJECTS in part the R&R Doc. 67 to the extent that the gun will not be suppressed, and ACCEPTS the R&R in all other respects. The Court hereby DENIES the defendants motions to suppress Docs. 35, 59 and the defendants motion to dismiss the indictment Doc. 43.
