ORDER noting the Court finds that the State of Tennessee is in substantial compliance with the terms of its Order of December 20, 2007, and that Petitioner's due process rights have not been violated during the conditional period. Accordingly, Petitioner's motion to issue an unconditional writ of habeas corpus and bar Petitioner's re-prosecution by the State of Tennessee is denied. The Clerk of Court is directed to close this case. Signed by District Judge Harry S Mattice, Jr on September 24, 2008. (AYB)
