MEMORANDUM as to Ronald H Cole: For the reasons set forth herein, the Court finds that Petitioner is entitled to relief under § 2255 and will grant his § 2255 motion [Doc. 33]. The Judgment imposed by the Court on September 2, 2005 [Doc. 30], will be vacated in part and Petitioners term of imprisonment willbe corrected and reduced to a sentence of time served on each of Counts One and Two of the Indictment. The 84-month term of imprisonment previously imposed on Count Three of the Indictment, to be served consecutively to the sentences imposed on Counts One and Two, remains in full force and effect. Further, the Judgment imposed on September 2, 2005 [Doc. 30], will be amended to reflect a term of supervised release of five years, consisting of five years on CountThree of the Indictment and three years on each of Counts One and Two of the Indictment, all such terms to run concurrently. In all other respects, the Judgment imposed on September 2, 2005 [Doc. 30], shall remain in full force and effect. The Clerk of Court will be directed to close the civil case at No. 4:17-CV-23.
