ORDER: The Report and Recommendation is adopted and approved with the following amendment: Pursuant to Stough v. Mayville Community Schools, 138 F.3d 612, 614 (6th Cir. 1998), the Court is not granting summary judgment simply because the Pltf has not responded, but it has examined Defts' Motion to ensure that they have discharged their burden. Defts' Motion for Summary Judgment 87 is GRANTED, and this action is DISMISSED. Defts' Motion to Continue the Trial Date 93 is DENIED as moot.
