MEMORANDUM and ORDER: Deft has filed a 14 motion to dismiss for failure to prosecute or alternatively to compel discovery and for sanctions. In the interest of having this case proceed on the merits, deft's request to dismiss this case as a discovery sanction is denied. However, it is ordered that pltf's counsel shall pay to the deft the reasonable expenses, including atty's fees necessitated by the filing of the motion to compel.
