REPORT AND RECOMMENDATION that the Defts' 148 MOTION for Attorney Fees and Nontaxable Costs be granted in part and that the Defts be awarded attys' fees in the amount of $52,357.99 and costs in the amount of $3,920. As previously discussed, the Magistrate Judge also recommends that Defts be awarded three percent of this amount for the preparation of the attys' fees motion, in the amount of $1,524.99.
