ORDER: For the reasons explained in the Memorandum entered contemporaneously herewith, the Court rules as follows: Defendant's Motion in Limine to Exclude the Testimony of Elizabeth Bisgard, M.D. 59 is Denied. Plaintiffs' Motion for Sanctions 87 is Denied. Defendant's Motion for Leave to File Supplemental Response in Support of Defendant La Quinta Inns, Inc.'s Motion for Summary Judgment 82 is Granted. The Supplemental Response is contained within the Motion and has been filed. Defendant's Motion for Summary Judgment 55 is Denied. This case is hereby returned to the Magistrate Judge for further proceedings consistent with Local Rule 16.01 to ensure that this case is ready for a non-jury trial set for 10/16/07 at 9:00 a.m. and the pretrial conference set for 9/17/07 at 3:30 p.m. Signed by Judge Robert Echols on 8/15/07. ORDER: For the reasons explained in the Memorandum entered contemporaneously herewith, the Court finds in favor of Defendant and against Plaintiffs on their negligence claims. The Court concludes that the Plaintiffs failed to prove Defendant's liability by a preponderance of the evidence.
