ORDER: For the reasons stated by the Magistrate Judge, Defts 30 MOTION to Strike and 28 MOTION to Strike are granted. REPORT AND RECOMMENDATION 50 is adopted and approved in part and overruled in part. The City of Murfreesboro and the Individual Defts' 19 Motion to Dismiss is granted in part and denied in part. All claims against the City are dismissed, and pltf's claims for negligence and outrageous conduct against the individual defts are dismissed. 14 Motion to Dismiss filed by Logan's Roadhouse, Inc. is granted and all claims against Logan's Roadhouse's are dismissed. ORDER granting 68 Motion for Partial Summary Judgment for reasons stated in the accompanying memorandum. Partial summary judgment is granted to defts as to pltfs' claims for "malicious abuse of process" (which has now been defined by pltfs as a claim for malicious prosecution), false arrest and false imprisonment, and those claims are dismissed.
