ORDER OF FINAL JUDGMENT: As explained more fully in the accompanying Memorandum Opinion, Pltf's 56 Motion for Summary Judgment and Deft's 67 Motion for Summary Judgment are granted in part and denied in part resulting in the resolution of all pending claims. Pltf will, however, be deemed the "prevailing party" and will be entitled to costs, including attorney's fees commensurate with its degree of success. All other outstanding motions are terminated as moot. All issues being resolved, this matter is terminated although the Court retains jurisdiction of the matters of costs and attorney's fees. ORDER granting in part 89 Motion for Attorney Fees as set forth in the accompanying memorandum. The motion is granted to the extent that Layman Lessons is entitled to atty fees in the amount of $53,721.50. The Court declines to rule at this time on Layman Lessons' claim for costs in the amount of $6,156.10 as the pltf's bill of costs is presently in the capable hands of the Clerk of Court.
