ORDER: In accordance with the Memorandum filed herewith, the Defts' motion for summary judgment 110 is GRANTED in part and DENIED in part. Pltf's federal law claims are DISMISSED with prejudice except as to Pltf's Fourteenth Amendment claim. The Deft's motion for summary judgment is DENIED as to Pltf's Fourteenth Amendment claim. Pltf's state law claims are DISMISSED without prejudice. The parties have 60 days to complete discovery.
