ORDER For the reasons explained in the accompanying Memorandum, the Court hereby enters the following rulings: (1) The 45 Report and Recommendation is hereby ACCEPTED and APPROVED; (2) Deft's 17 Motion to Dismiss is hereby GRANTED; (3)Pltf's 28 Motion for Summary Judgment is DENIED AS MOOT; (4) Pltf Hooker's 54 Objections to the Report and Recommendation are OVERRULED; (5) Pltf Johnson's 59 Objections to the Report and Reccommendation are OVERRULED; (6) Pltf Hooker's 64 Motion for Permission to File a Reply is GRANTED; (7)Pltf Hooker's 65 Amended Motion for Permission to File Reply and Request for Oral Argument is GRANTED IN PART and DENIED IN PART, request to file reply is Granted, request for oral argument is DENIED; (8) This case is hereby DISMISSED WITH PREJUDICE.
