ORDER: For the reasons explained in the Memorandum issued contemporaneously, the Court rules as follows: 48 Report and Recommendation is accepted and approved; Objections to the Report and Recommendation 52 are overruled; 29 Motion to Dismiss is granted; 42 Motion to Strike is denied as moot; 50 Motion to Disqualify Counsel or in the alternative for Sanctions is denied as moot, and therefore, Pltf's 57 Motion for Leave to Reply is also denied as moot; 63 Motion to issue subpoenas is denied as moot; 61 Motion for Extension of Time to Complete Discovery is denied as moot. This case is dismissed with prejudice. Entry of this Order on the docket shall constitute entry of a final judgment in accordance with FRCP 58 & 79(a). Signed by Judge Robert Echols on 3/21/08. (km)
