ORDER: The Clerk will file the complaint in forma pauperis. Pltf is assessed the civil filing fee of $350.00. The custodian of the pltf's inmate trust fund account is directed to submit to the Clerk of Court an initial payment as outlined in this Order. As provided in the Memorandum entered contemporaneously herewith, pltf's complaint is dismissed without prejudice for failure to state a claim on which relief may be granted at this time. Pltf is not certified to pursue an appeal from this judgment in forma pauperis. Entry of this Order shall constitute the judgment in this action. Signed by Judge William J. Haynes Jr. on 2/14/08.
