REPORT AND RECOMMENDATION: Based on the foregoing, the Court respectfully RECOMMENDS that: Defendants' motion for summary judgment (Docket Entry No. 50) be GRANTED. All claims brought under 42 U.S.C. § 1983 should be DISMISSED WITH PREJUDICE, and any state law claims should be DISMISSED WITHOUT PREJUDICE; and Defendants' motion to dismiss (Docket Entry No. 60) be DENIED as moot in light of the recommendation that summary judgment be granted to Defendants.
