REPORT AND RECOMMENDATION re 8 First MOTION to Dismiss for Failure to State a Claim filed by Danielle W. Barnes. Based on the foregoing, the undersigned RECOMMENDS that Barnes's motion to dismiss for failure to state a claim be GRANTED and that this action be DISMISSED WIHOUT PREJUDICE to Amadi filing an amended complaint to add the proper defendant(s).
