ORDER DISMISSING CASE: As provided in the Memorandum entered contemporaneously herewith, petitioner's motion for de novo review is denied; petitioner's request for "plenary review" of his claims that Dr. Harlan engaged in professional misconduct is denied; petitioner's motion for summary judgment is denied. The respondent's motion for summary judgment is GRANTED; petitioner's petition for habeas corpus relief are denied and this action is DISMISSED.
