Findings, Conclusions and Recommendation. It is RECOMMENDED that 106 Motion for Judgment filed by Richard Weihert and 99 Motion for Summary Judgment filed by Sherry Terry and Sandra Castillo should both be granted, such that all Plaintiff's claims, except his state law claims, should be dismissed with prejudice and Plaintiff's state law claims should be dismissed with prejudice. Case reassigned to Senior Judge Sam R Cummings for all further proceedings. Magistrate Judge E. Scott Frost no longer assigned to case. (Ordered by Magistrate Judge E. Scott Frost on 7/28/2016) (mmg)

Order Accepting Findings, Conclusions and Recommendations. It is ORDERED that Richard Weihert's Motion for Judgment on the pleadings and Motion for Summary Judgment of Defendant Sherry Terry and Sandra Castillo are GRANTED. It is further ORDERED that all of Plaintiff's claims, except his state law claims, are DISMISSED with prejudice; and Plaintiff's state law claims are DISMISSED without prejudice.
