Memorandum Opinion and Order. In sum, the Court finds that Plaintiff failed to make a timely demand for a jury trial under Rule 38 of the Federal Rules of Civil Procedure. However, no strong and compelling reasons exist for denying Plaintiff's Rule 39(b) motion 44 for jury trial. Accordingly, Plaintiff's motion is GRANTED.
