FINDINGS, CONCLUSIONS, AND RECOMMENDATION re 21 Amended MOTION to Dismiss filed by J Capps, Marne Boyle, S Middleton. It is RECOMMENDED that the District Court grant in part and deny in part Defendants' Amended Motion to Dismiss and Brief in Support (Doc. # 21). The Court should grant the motion to dismiss all of Plaintiff's claims asserted against Defendants in their individual capacities for lack of jurisdiction. The Court should deny the motion to dismiss on all other grounds.
