Findings and Recommendations on Case re: 1 Petition for Writ of Habeas Corpus filed by Quintin Lee Alonzo. The Court should GRANT petitioner relief on the first ground, DISMISS the second ground as procedurally barred, and DENY petitioner's remaining claims with prejudice. The petition for writ of habeas corpus should be conditionally granted, and the writ should issue unless petitioner is retried within 180 days after these findings are accepted.
