FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE on case: It is recommended that the petition be denied and dismissed. It is further recommended that Johnson's motion to compel and motion for leave for discovery filed on 02/29/08 be denied as moot. In addition, because the court has considered the supplemental brief filed by Johnson on 04/16/08, his motion to enlarge argument filed on the same date is likewise moot. Magistrate Judge Wm F Sanderson, Jr no longer assigned to case. (Signed by Magistrate Judge Wm F Sanderson, Jr on 4/18/2008) (twd)
