FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE on case: It is recommended that Plaintiff's complaint be DISMISSED for want of subject matter jurisdiction. Alternatively, it is recommended that the complaint be dismissed with prejudice as frivolous and for seeking to sue defendants who are immune from such relief. Any Heck barred claims should be dismissed with prejudice as frivolous to their being asserted again until the Heck conditions are met. Magistrate Judge Paul D Stickney no longer assigned to case. (Signed by Magistrate Judge Paul D Stickney on 5/9/2008) (twd)

ORDER: It is ordered that the 23 findings, conclusions, and recommendation of the magistrate judge are adopted in part. In relevant part, plaintiff objects to the magistrate judges findings, conclusions, and recommendation, contending that he is "a legal resident of the State of Missouri." On this basis. the court will hold that it has jurisdiction based on diversity of citizenship. The court agrees, however, with the magistrate judge's alternative findings, conclusions, and recommendation that this case should be dismissed as frivolous. The court also concludes that plaintiff is not entitled to appointed counsel to present legally frivolous claims against these defendants. (See Order for specifics.) (Signed by Judge Sidney A Fitzwater on 6/11/2008) (twd)
