FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE on case: It is recommended that this habeas action be DISMISSED WITHOUT PREJUDICE. The Court should BAR petitioner from proceeding in forma pauperis in any future habeas action as set forth herein and WARN petitioner that, if he continues to engage in abusive litigation practices or files another successive habeas petition without first obtaining leave from the Fifth Circuit, he will be subject to additional sanctions, up to and including monetary sanctions payable to the Court and being barred from filing any additional habeas actions in federal court without first obtaining permission from the Court.
