FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE. Because this Court lacks subject matter jurisdiction over the action, the District Court should dismiss this case without prejudice and DENY as MOOT the following motions: (1) Defendant Pryors Motion to Dismiss Under FED. R. CIV. P. 12(b)(2)(5) and (6) (doc. 10), (2) Defendant Judge Magnis Motion to Dismiss Under Federal Rules 12(b)(1) and 12(b)(6) (doc. 12), and (3) Defendant Millers Motion to Dismiss Under FED. R.
