Findings, Conclusions, and Recommendation re: 32 Defendant's [sic] Motion to Exclude/Dismiss Individual Natural Persons of L.L.C. from Litigation. The defendants' motion to dismiss should be GRANTED in part, and Plaintiff's usury, breach of implied contract, sworn account, quantum meruit, unjust enrichment, and breach of fiduciary duty claims against Darrell Gray and Ethel Yolanda Gray should be DISMISSED. The motion to dismiss Plaintiff's usury, breach of implied contract, sworn account, quantum meruit, unjust enrichment and breach of fiduciary duty claims against Johnny Gray III, and the defamation, libel, intentional infliction of emotional distress, and intentional interference with prospective economic advantage claims against all individual defendants, should be DENIED, and these claims should be permitted to proceed.
